ART.275 CHAPTER 3 of the Code of the Philippines

TOPIC: LEGITIMATED CHILDREN


Art. 275. Legitimation may be impugned by those who are prejudiced in their rights, when it takes place in favor of those who do not have the legal condition of natural children or when the requisites laid down in this Chapter are not complied with. 

DISCUSSION: 

      
Only interested persons may impugn the legitimation of a natural child or natural children. There are persons who may be prejudiced by such legitimation in the form of lesser or no inheritance or lesser support. The ground under which legitimation maybe impugned may be that the child does not possess the status of a natural child or that the subsequent marriage between the child's parents was not valid.
